RELEASE, RECLAIM, RENEW SACRED RETREATS

 

RETREAT LIABILITY WAIVER

In consideration for participating in Release, Reclaim, Renew Sacred Retreats The Magic of Going Inside Winter Retreat, the undersigned acknowledges, aligns to and honors the following:

​

I understand that I am encouraged to seek my physician’s approval prior to participating in this or any other wellness retreat that may include physical activity or other health and wellness practices. I accept responsibility for my health and well-being as it pertains to my participation in this retreat and acknowledge that my participation is voluntary.

Although trained professionals will be facilitating & instructing the retreat, I assume responsibility for monitoring my physical condition and will alert the instructor and/or cease participation should any unusual symptoms occur or if I otherwise should choose to do so.

I knowingly and freely assume all known and unknown risks and take full responsibility for my participation.

I agree to indemnify, defend, and hold harmless Joanne Adducci and Claire Schulz Bergman, Release, Reclaim, Renew Sacred Retreats its affiliates, owners, members, employees, agents, and independent contractors for any injury, damage, liability, claim or other cause of action arising out of or related to the retreat I participate in.

I further agree to release and discharge Joanne Adducci and Claire Schulz Bergman, Release, Reclaim, Renew Sacred Retreats, its affiliates, owners, members, employees, agents, and independent contractors of and from any and all liability, claims, demands, and causes of action whatsoever, arising out of or related to any illness, loss, damage, or injury, including death, that I may sustain while participating in the retreat. I expressly agree that, to the fullest extent permitted by law, the maximum total liability of the above entity and persons, collectively, for any claims, breaches or damages by reason of any act or omission does not amount to willful or intentional misconduct shall be limited to $100.00. I agree to bring any action within 120 days of my participation in the retreat during which my claim arose.

No Guarantees. Joanne Adducci and Claire Schulz Bergman, Release, Reclaim, Renew Sacred Retreats, have not made any guarantees about the results of participating in the retreat. Any results achieved may be due to a multitude of factors, including your own efforts, your particular situation, and countless other circumstances beyond the control and/or knowledge of Joanne Adducci and Claire Schulz Bergman, Release, Reclaim, Renew Sacred Retreats. You also recognize that prior results do not guarantee a similar outcome.  The results obtained by others are no guarantee that you or any other person will be able to obtain similar results.

Assumption of Risk. Participation in physical and other health and wellness-related activities can involve all types of body movements, including motion, rotation, and height, in a unique environment and carries with it certain risks. Likewise, it can involve mental challenges and deep personal reflection. You are choosing to voluntarily sign this waiver, knowing your present condition and knowing that said condition might worsen or that you might experience injury during the time you participate in the retreat. You voluntarily and expressly assume any and all risks of loss, damage, or injury that you may sustain. Joanne Adducci and Claire Schulz Bergman, Release, Reclaim, Renew Sacred Retreats shall not be obliged to carry insurance on your behalf, and the existence of insurance shall not change, alter, or increase the liability of Joanne Adducci and Claire Schulz Bergman, Release, Reclaim, Renew Sacred Retreats to you or affect the terms of this waiver. In signing this waiver, you acknowledge a) that you have read this waiver thoroughly, understand it completely, and sign it voluntarily and b) that you are signing either for yourself or as the legal guardian and if you are signing as a legal guardian, you are representing that you are the true, current legal guardian and have the consent of the participant.

Likeness Release. I understand that during the course of the retreat, there may be some content captured, and by way of my presence at the retreat, I may be included in the content. I understand that this content may be used for business purposes, including public dissemination, Joanne Adducci and Claire Schulz Bergman, Release, Reclaim, and Renew Sacred Retreats. I hereby waive any right to inspect or approve any content that uses my Likeness and release and discharges Joanne Adducci and Claire Schulz Bergman, Release, Reclaim, Renew Sacred Retreats from any and all actions, claims and demands of any nature which I may have at any time now or in the future, arising out of or related to the rights grants above or my Likeness.

Governing Law, Dispute Resolution, and Venue. This waiver shall be governed by and interpreted under the laws of the State of Wisconsin. If any dispute, controversy or claim arises between the parties with respect to this waiver or any future amendment to this waiver, the parties will submit the matter for mediation before a mutually agreed upon mediator. If mediation does not result in an agreement, the parties agree to Wisconsin state courts in Madison, Wisconsin, as the venue for any litigation regarding this Agreement, including the rights and obligations of any party to this Agreement.

Refunds & Cancellations. I understand that 80% of my full payment is non-refundable. If I should need to cancel or cannot attend the retreat, I understand I must inform Joanne Adducci or Claire Schulz Bergman by November 15, 2022, and that in this event, I will be refunded 20% of my full payment.

I HAVE READ THIS WAIVER, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND UNDERSTAND MY PAYMENT INDICATES ACCEPTANCE AND AGREEMENT WITH TERMS AND CONDITIONS.
